Application Package -Incomplete
Dear Mr. Simmer:
On September 4, 1997, the Division of Minerals and Geology received your 112 Construction Materials
Reclamation Permit Application package for the Everhart Pit, which issued a new number, File No.
M-97-081, because of the withdrawal of your previous application. Preliminary review of the information
received determined that the following items must be received before the Division can consider your
application as being submitted and technical review can begin:
I) EXHIBIT O -Proof of Nlailine of Notices to County Commissioners and Soil Conservation
District (Rule 6.4.17): Please submit proof of actual delivery or proof of mailing by Certified Mail,
return receipt requested, of Notice of the Application to the local Board of County Commissioners
and, if the mining operation is within the boundaries of a Soil Conservation District, to the Board
of Supervisors of the Soil Conservation District.
Apparently the notice was mailed to the Soil Conservation Service which is a federal agency. The
correct address is: South Pueblo Soil Conservation District, Board of Supervisors, % Douglas
G. Thacker, 1626 Highway 50 West, Pueblo CO 51008. Please see the enclosed memo
regarding this issue. /n order to satisfy our notice requirements, it is important to notify the
appropriate SCD office and Board of Commissioners. These agencies are not the same, nor are they
interchangeable for our notice requirements. Please verify that the correct agency receive notice.
2) EXHIBIT S -Permanent Man-Made Structures (Rule 6.4.19): You must provide information
sufficient to demonstrate that the stability of any structures located within two hundred (200) feet
of the operation or affected land will not be adversely affected.
The E.cltibit appears to be a response to an Envirat:ntental Protection Ptctn requirement rather than
an accounting of any man-made structures. Because this is a Construction Materials application
nttd not a Hard Rocl/Metal Mining application, the e_rltibit, as presented, is inappropriate. Please
sttbntit a corrected exhibit.
