adjacent land uses include residential (single family housing), industrial and commercial <br />(equestrian center, sand and gravel mine), and recreation (golf course development). <br />These land uses aze compatible with the La Plata County planning designations. As there <br />are no state or federal lands within the permit area, no state or federal land management <br />agencies have any valid interest in the land use of this property. Adjacent BLM surface <br />lands have been classified as ungulate winter range with recognition of mineral <br />development and extraction land uses. <br />Post-Mining Land Use Feasibility <br />Where necessary, the rules require a feasibility demonstration of the post-mining land use <br />related to projected land use trends and mazkets. This demonstration and accompanying <br />plans aze not necessary, as the landowner is the developer and operator of the commercial <br />ventures taking place on the property. As such there will be no outside interests which <br />will dictate land use trends and/or markets. Landowners are entitled to conduct <br />operations and businesses on their own property which are consistent with the approved <br />general land uses. Successful reclamation will be accomplished on disturbed areas within <br />the permit area boundary which would not be of use in the development, construction, or <br />operation of the planned and approved land uses. Designation of an alternative land use <br />would in no way hinder reclamation. Where modifications to the approved reclamation <br />plan are required to best serve the approved post-mining land uses, Oakridge Energy will <br />secure these prior to initiation. <br />Public Hea/th and Safety <br />The proposed uses would not present actual or probable hazard to public health or safety, <br />nor actual or probable threat of water flow diminution or pollution. Residential and <br />recreational development is regulated by the La Plata County Planning Department. <br />Public health and safety issues are therefore addressed within the context of their review <br />and approval of projects. Public health and safety issues for the operation of the <br />industrial and commercial ventures will be regulated by MSHA (mining) and OSHA <br />(other commercial ventures). For the existing land uses as described above, the required <br />development, operation, and reclamation permits have been or will be secured. <br />Reclamation Delays <br />As these land uses have already been implemented, there would be no delay in <br />reclamation of the mine site attributable to implementation of the post-mining land uses. <br />Fish and Wildlife Values <br />This rule pertains to alternative land use changes proposed during a permit application <br />process and prior to surface coal mining operations.
