M-91-011 and M-92-017) <br />Termination of File M-91-011 and Consolidation of the File <br />Dear Mr. Roberts: <br />This. letter is to notify you, as listed contact for Montrose County for Permit M-92-017, <br />that quite recently the Division became aware that Montrose County had been issued two <br />separate permits for the same gravel pit. Permit No. M-91-011 for the BLM/West End Pit <br />was. issued under provisions of Section 111 of the Mined Land Reclamation Act on <br />March 19, 1991; Permit No. M-92-017 for the BLM/West End Pit was issued under the <br />provisions of Section 110(2) of the Act on April 24, 1992. Apparently the Division did not <br />recognize that the application for the 1 10(2) permit received in 1992 was in fact a <br />conversion of an existing 111 permit and was not for an entirely new mine. <br />In order that there be no such duplication of permits for any single site in the Division <br />records, the Division has terminated File (and Permit) M-91-O1 1 and combined the <br />contents of that file with those of File (and Permit) M-92-017, which apparently covers the <br />san-le site, i.e., BLM/West End Pit. <br />The results of this consolidation are as follows: <br />11 Montrose County will not be required to pay annual fees and <br />supply annual reports for Permit M-91-011 since that permit is <br />to be terminated. Annual fees and an annual report for <br />Permit M-92-017, however, will still be required. <br />21 The application fee, 5875.00, provided by Montrose County <br />for Permit M-92-017 will be returned. By state statute, there <br />is no charge made by the Division for the conversion of a 1 11 <br />permit to a 1 1012). <br />
