G <br /> FINAL PLAT NOTES: <br /> Stipulation Regarding Nearby Wells <br /> A, This stipulation applies to those shallow wells located within <br /> 1,000 feet of any property line of Stagecoach Stop Pit and on the <br /> east side of the South Platte River. Further, this stipulation applies <br /> to Western Paving Construction Co., their successors, heirs, assigns, <br /> operators, and subcontractors who may be performing the gravel mining <br /> operation at the Stagecoach Stop Pit. Reference to Western Paving <br /> Construction Co. in this stipulation means Western Paving Construction <br /> Co. and their successors, heirs, assigns, operators and subcontractors. <br /> It shall be the responsibility of Western Paving Construction <br /> Co. to install and maintain at least six groundwater monitoring wells, <br /> two each on north, east and south perimeters of Stagecoach Stop Pit. <br /> Groundwater level reports must be submitted to the Adams County <br /> Planning Department prior to any excavation at the site, and at three- <br /> month intervals thereafter by Western Paving Construction Co. Western <br /> Paving Construction Co. hereby authorizes any Adams County employee <br /> to examine the groundwater monitoring wells to determine the accuracy <br /> of said reports. <br /> Owners of shallow wells located within 1 ,000 feet of <br /> Stagecoach Stop Pit shall be afforded the opportunity to participate in <br /> data collection pertaining to groundwater levels in this defined area. <br /> In order to participate, well owners must meet the following criteria: <br /> 1. The shallow well is authorized through the Colorado <br /> Division of Water Resources. <br /> 2. The well depth does not exceed the planned level of <br /> excavation of Stagecoach Stop Pit. <br /> 3. Well owners submit to Adams County, complete reports, <br /> on forms provided by the Planning Department, at <br /> the same frequency as Western Paving Construction Co. <br /> Data collected will be available for public inspection at <br /> the Planning Department during regular working hours, <br /> The Planning Department shall notify by mail all landowners <br /> on record within 1 ,000 feet of the perimeter of Stagecoach Stop Pit of <br /> this stipulation. Such landowners must notify the Planning Depart- <br /> ment within 60 days of approval of the County Commissioners of their <br /> intention to participate in the procedure stated above to be eligible. <br /> B. Hours of operation will be limited to 6-00 am. to <br /> 7-00 pm. <br /> C. Western Paving agrees to participate in its <br /> proportionate share of improvements at the intersection of 124th and <br /> Old Brighton Road relative to its demand in the form of traffic. <br /> D. No mining will take place on the southernmost one <br /> (1) acre and no stockpiles of material will be placed within 100 feet <br /> of the intersection of 124th Avenue and Old Brighton Road. <br /> E.
