Stipulation Regarding Nearby Wells
A, This stipulation applies to those shallow wells located within
1,000 feet of any property line of Stagecoach Stop Pit and on the
east side of the South Platte River. Further, this stipulation applies
to Western Paving Construction Co., their successors, heirs, assigns,
operators, and subcontractors who may be performing the gravel mining
operation at the Stagecoach Stop Pit. Reference to Western Paving
Construction Co. in this stipulation means Western Paving Construction
Co. and their successors, heirs, assigns, operators and subcontractors.
It shall be the responsibility of Western Paving Construction
Co. to install and maintain at least six groundwater monitoring wells,
two each on north, east and south perimeters of Stagecoach Stop Pit.
Groundwater level reports must be submitted to the Adams County
Planning Department prior to any excavation at the site, and at three-
month intervals thereafter by Western Paving Construction Co. Western
Paving Construction Co. hereby authorizes any Adams County employee
to examine the groundwater monitoring wells to determine the accuracy
of said reports.
Owners of shallow wells located within 1 ,000 feet of
Stagecoach Stop Pit shall be afforded the opportunity to participate in
data collection pertaining to groundwater levels in this defined area.
In order to participate, well owners must meet the following criteria:
1. The shallow well is authorized through the Colorado
Division of Water Resources.
2. The well depth does not exceed the planned level of
excavation of Stagecoach Stop Pit.
3. Well owners submit to Adams County, complete reports,
on forms provided by the Planning Department, at
the same frequency as Western Paving Construction Co.
Data collected will be available for public inspection at
the Planning Department during regular working hours,
The Planning Department shall notify by mail all landowners
on record within 1 ,000 feet of the perimeter of Stagecoach Stop Pit of
this stipulation. Such landowners must notify the Planning Depart-
ment within 60 days of approval of the County Commissioners of their
intention to participate in the procedure stated above to be eligible.
B. Hours of operation will be limited to 6-00 am. to
7-00 pm.
C. Western Paving agrees to participate in its
proportionate share of improvements at the intersection of 124th and
Old Brighton Road relative to its demand in the form of traffic.
D. No mining will take place on the southernmost one
(1) acre and no stockpiles of material will be placed within 100 feet
of the intersection of 124th Avenue and Old Brighton Road.
E. Construction of an access road and accel lane at
126th and Old Brighton Road shall be completed prior to hauling of
gravel from this pit.
