used in mining.

5. The haul road shown on Map 3 shows the length of the existing ranch road
to be approximately 200 feet rather than the stated length of approximately
165 feet. The paragraph states that office and maintenance buildings exist and
to our knowledge they do not exist and do not appear on any plan showing
exhibiting buildings. In addition, the paragraph makes reference to a
temporary office trailer that may be needed and this is inconsistent with the
statement made in the SUP application that, "Temporary structures include
a portable toilet facility. No office or maintenance facilities are proposed."
Also there is no mention of scales in the SUP application and these buildings
and scales are not included on the maps submitted to the county.
Response: Again, the opponents of this project lack an understanding regarding
the evolutionary nature of developing a mining deposit. Yes, the Applicant
originally did not anticipate the need for on-site facilities, but subsequent
planning has identified the need for such facilities. All permits are issued with
provisions for amendment or modification and the Applicant has already formally
contacted Routt County regarding the need to revise their SUP. However, this
has virtually no bearing on the processing and approval of the state permit.
With respect to the discrepancy between the distances of approximately 165 feet
and approximately 200 feet. We merely refuse to comment on such statements.
The "existing office and maintenance buildings' mentioned in this paragraph are
located north of US Highway 40 at the physical address of 40694 Routt County
Road # 186, in the west Steamboat Springs area and since this location is nearly
six miles away from the proposed mine site, these facilities are not shown on the
project maps.
9. There was no mention of sumps in the application to the county. We
question the amount of additional noise that the sumps will create.
Response: Again the opponents are confused at the terminology used in mining.
Sumps in the state permit are used in the context of sediment ponds or erosion
control structures. In this context they are specifically mentioned on page 9 in
addressing the drainage control plan of the Routt County SUP. The Applicant is
unfamiliar with how sediment ponds, and detention basins or sumps will create
additional noise.
13. Owners. There is no documentation submitted with this application as
required by the Rules and Regulations providing proof of ownership of
surface or mineral rights. The deed presented in this packet is irrelevant to the
ownership rights. In addition, the relevant deed on record does not grant
14
