The date of the Office decision is today, May 5, 1998. The <br />condition for approval is that mining operations shall not result in slope segments being steeper than <br />2H:1 V. This decision is based on a determination by the Office staff that the applicant has met the <br />permit application adequacy requirements set forth in the Colorado Land Reclamation Act for the <br />Extraction of Construction Materials, and in the Construction Materials Rules and Regulations of the <br />Colorado Mined Land Reclamation Board. <br />Any person aggrieved, by any final action of the Office, may file an appeal of such action before the <br />Colorado Mined Land Reclamation Board within sixty (60) days of the date of the Office decision. <br />The Request for Administrative Appeal must specify the application number assigned by the Office <br />and all factual and legal questions which the aggrieved person wishes to have the Board decide. <br />Please contact me at the DMG Durango Office, 484 Turner Drive, Building F, Suite 101, Durango, CO <br />81301, phone (970) 247-5469, if you have any questions. <br />Sincerely, <br />Wallace H.
