The Pernittce, Rough Cut, LLC desires to conduct a mining operation larown as Rough Cut <br />Pit, for the purpose of extruding sand and gravel. The Pemrittce will nd more any secondary commodities. <br />B. On May 31, 2001 the Mined Land Reclanration Board (the "Board") approved the Permittee's <br />application for this permit, fixed the amount ofthe financial warranty and directed that this permit be issued upon <br />the filhrg with the Division of Minerals and Geology (the "Division") of perfornance wararrty and financial <br />warranty (or warranties) in the amount so fixed ¢r Porn and substance approved by the Division. Said warranties <br />have heal filed with the Division. <br />C. ifthe Pernittce desires to extract materials other than those listed in (A), a separate permit may <br />be required. <br />D. On May 31, 2001 the Board made the following findings: <br />1. The application for this pemtit congrGes with the requiremarts of the Colorado Mined <br />Land Reclamation Ad for the Extraction of Construction Materials, C.R.S. 34-32.5-101 et sue., as amended, and <br />with all applicable local, state and federal laws; <br />2. The operation will nd adversely afled the stability of any sigrificarrt, valuable, and <br />pernanart man-made structure located within two hrmdred fed of the Affected Land, except where there is an <br />agnjemart between the Operator and the persons having an interest in the structure that damage to the structure is <br />to be corr>pensated for by the Pem»ttee; and; <br />
