<br />M-97-071 <br />Page 7 <br />either: <br /> <br />(a) provide a notarized agreement between the applicant and the person(s) having an interest <br />in the structure, that the applicant is to provide compensation for any damage to the <br />structure; or <br />(b) where such agreement can not be reached, the applicant shall provide and appropriate <br />engineering evaluation that demonstrates that such structure shall not be damaged by <br />activities occurring at the mining operation. <br />As noted in the pre-operation inspection and on the warranty deed, there is a water line and two <br />associated wells located within the permit azea as well as two power lines traversing the site from <br />east to west. Please provide the appropriate notarized agreement or engineering study to address <br />any potential damages to these structures. <br />6.5 GEOTECHNICAL STABILITY EXHIBIT <br />No comment at this time. <br />This concludes the Division's preliminary adequacy review of this application.
