<br />By the end of the initial public comment period the Division had received several comment and <br />objection letters regarding the application. The issues ranged from local government issues such as <br />transportation, visual impact and tourism impact, to several issues the Division and Board have <br />jurisdiction over. Issues have been raised regarding aspects of the mining and reclamation plans, <br />wildlife impacts, pollution control, surface and groundwater quantity and quality, blasting impacts, <br />and others. It seems that ground water and blasting impacts are the primary issues objectors are <br />concerned with. Their concerns include well/spring water quantity and quality, which they feel the <br />mining operation will diminish and blasting which they feel could pose a threat to them and their <br />property due to rock fall and to their water supplies due to damage from ground motion. <br />After the adequacy letter was sent, the applicant employed a new consultant and with his guidance a <br />number of professional engineering and hydrology firms were contracted with for studies, and <br />design services to answer the Division's adequacy review questions. The applicant continued the <br />application decision date several times to give themselves time to respond to the Division's <br />adequacy letter. <br />On September 18, 1997, the Division conducted an Informal Conference in Canon City and all <br />commentors and objectors were invited to attend along with the applicant and his consultants. <br />Some additional comment and objection letters were received in conjunction with the informal <br />conference. <br />On January 12, 1998, Agile Stone Systems submitted three (3) large volumes of information as a <br />response to the Division's adequacy letter. The Division decided that the response constituted an <br />amended application and set a new decision date of April 1, 1998. However, we decided that the <br />review process was going well enough to render our decision (recornmendation to the Board and <br />Parties) on March 4, 1998 and schedule the Hearing for the March 26-27, 1998 Board meeting. <br />Sincerely, <br />~~Z~~ ~~ <br />Larry D.
