Damage as a result of improper ditch <br />cleaning or other activity by others not associated with Snowmass Coal <br />will not be the responsibility of Snowmass Coal. <br />During final reclamation of the loadout site, Snowmass Coal will <br />request written comments from the ditch owner on whether they want the <br />ditch retained as is or have the concrete structure removed and the <br />original ditch cross section and grade replaced. The owner will have <br />fifteen days in which to respond. <br />The cost for removal of the structure is included in the reclamation <br />cost section. <br />4.6.2.3.6 Water Rights and Augmentation <br />A Plan of Augmentation has been filed in the District Court for Water <br />District Number 5. The plan proposes to change 5.3 cubic feet per <br />• second of direct flow irrigation rights from the Crane & Pebbles <br />(Roaring Fork) and the Southard 8 Cavanaugh (Crystal) Ditches to <br />industrial, domestic, irrigation, mechanical, mining, and other pur- <br />poses in connection with the mining and processing of natural resour- <br />ces, including coal. ~~ <br />.x <br />The plan proposes to continue the existing points of diversion or to <br />have alternate points of diversion at either or both of two new wells <br />drilled in the alluvium at the loadout facility. A separate storage <br />right was filed simultaneously with the plan to allow storage of up to <br />15.0 acre-feet of water at the facility. Water would be diverted, in <br />priority, during the historic irrigation season. A portion of the <br />water would be stored.
