STATEMENT OF CERTIFICATION
I, John Effinger III, a Registered Professional Engineer &
Land Surveyor in the State of Colorado, Certification #13746,
hereby certify that on May b, 1993, I did perform an inspection
and field survey of the above referenced refuse ditch, and that
with subsequent compilation of field data have found said ditch
to be in general conformance with the requirements of Section
4.05.4 (2), Regulations of the Colorado Mined Land Reclamation
Board for Coal Mining, and with the certified design plans of the
Technical Revision Request #7 (TR-07) Document, prepared by ACZ
Inc, Engineering S Environmental Services, dated August 24, 1989
and revised Feburary, 1990. The channel configuration and floc,
capacity of this ditch, a portion of channel sections B, equals
or exceeds all applicable performance standards and design crite-
ria of Section 4.05.4 (2) of CMLRB Regulations.
