Cattany <br />Division Director <br />Natural Resource Trustee <br />On February 23, 2007, the Division received the above referenced application. Pursuant to <br />Construction Materials Rule 1.4.6 the decision date for the application is March 25, 2007. <br />Please be advised that the application may be deemed inadequate and may be denied on <br />March 25, 2007, unless the following adequacy review items are addressed to the Division's <br />satisfaction. If additional time is necessary to respond to these adequacy issues please request <br />an extension to the decision date. <br />1. Pursuant to Construction Materials Rule 1.6.2(1)(8), please provide proof of notice for the <br />newspaper publication required by Rule 1.6.2(1)(d), and notice to surface and subsurface <br />owners of the affected land and to surface owners within 200 feet of the permit boundary, as <br />required by Rule 1.6.2(1)(e). <br />2. In Exhibit B, Site Description, the application indicates that a storage shed is located <br />within 200 feet of the permit boundary but that its owner, John Martinez, does not consider the <br />shed to be a significant structure. During the inspection, the shed appeared to be currently in <br />use and not abandoned. Please submit the damage compensation agreement, required by <br />Rule 6.3.12(a), or the engineering evaluation, required by Rule 6.3.12(b), for the storage shed. <br />Please revise Exhibit L to identify the shed. <br />3. Please revise Exhibit B and L to identify County Road 391 as a permanent man-made <br />structure within 200 feet of the permit boundary, as required by Rule 6.3.2(b) and 6.3.12. <br />Please provide the damage compensation agreement, required by Rule 6.3.12(a), or the <br />engineering evaluation, required by Rule 6.3.12(b), for County Road 391. <br />4. In the Geotechnical Stability Exhibit, the application indicates that the final cut slope will <br />not be steeper than 4H:1 V (.25V:1 H). Please verify the configuration of the final cut slopes. <br />Please note that the Reclamation Map indicates final cut slopes at approximately 0.8H:1V. <br />5. In Exhibit D, Reclamation Plan, the application indicates a maximum gradient of the <br />reclaimed section at 3:1 slope.
