Box 550 Rocky Ford, CO 81067, 719-254-7464 has filed an <br />application for a Regulaz (112) Construction Materials Operation Reclamation Permit <br />with the Colorado Mined Land and Reclamation Board. The proposed mine is known as <br />the Valco T. Pit, and is located at or neaz Section 35, Township 325, Range 63 W, Sixth <br />Prime Meridian. <br />Las Animas County Commissioners aze expected to address the issue on July 12, 2004, <br />The Division of Minerals and Geology requires input on or before July 23, 2004. <br />It has recently come to my attention that said location encompasses an old, sacred Indian <br />Burial Ground. As a landowner in Las Animas County, and as a shazeholder and member <br />of the Boazd of Directors of Duran's Rodeo Ranch Inc. in Model, CO, I would hope that <br />the County Commissioner's of Las Animas County would find it fitting to protect and <br />preserve this part of our local history. <br />On a more human level, I believe, and Colorado State law agrees, that any human <br />remains aze entitled to dignity and respect. I find it especially offensive that, purposely <br />or by accident, human remains may be included as `construction materials'. I believe this <br />falls well within the state law definition of `desecration' (mistreating in a way that the <br />defendant knows will outrage the sensibilities of persons likely to observe or discover his action <br />or its result). <br />If the permit is granted, the remains will be discovered and state law sets forth certain <br />procedures that must be followed from that point. I seek your assistance in protecting <br />and preserving the dignity of these remains, and making sure that it never gets to the <br />point where the remains aze disturbed. <br />I ask that the Division of Minerals and Geology, and the Las Animas County <br />Commissioners be proactive by withholding the requested permit until the proper <br />
