T¢ date, I have not received any response, nor have I received
any indication that the certified letter got through to you. I have also
attempted to contact you by telephone to let you know that I had sent this
letter. To d~,~e that has not succeeded either. Therefore, I have
resolved to t,~y one more time to contact you in relation to this matter.
Your applicat;on for a mining and reclamation permit is scheduled for
consideration,by the Mined Land Reclamation Board during the May 27th
meeting to be held at Fairfield Center, 200 Main St., in Meeker, Colo.
without a res~onse to my adequacy letter of May loth, I will be forced to
recommend that; they deny this permit on the grounds that it is inadequate
to be approved under the terms of the Mined Land Reclamation Act.
If you will send me a written request for a continuance of this matter
until the June, 29-25 meeting, I will request this from the Board. However,
if I do not receive either such a request or a response to my adeg:racy
letter from. you by the morning of May 26th (next Tuesday), I will .request
that the Board deny your permit application and authorize me to schedule
your opera tior~ for consideration of possible civil penalties. I should
also remind you that your operation is under a Board Cease and Desist
Order and no raining may occur until you have an approved permi`.
I have enclosed another copy of my adequacy letter.
