Cattany <br />Division Director <br />Montrose, CO S 1401 Natu21 Resource rrustee <br />Re: Upper Animas Sand and Gravel Pit, File No. M-2005-065, Receipt of 110 Construction Materials <br />Reclamation Permit Application Package <br />Dear Mr. Ponchak: <br />On September 6, 2005, the Division of Minerals and Geology received your the 110 Construction Materials Reclamation <br />Permit Application package for the Upper Animas Sand and Gravel Pit, File No. M-2005-065, Preliminary review of the <br />information received determined that the following items must be received before the Division can consider your <br />application as being submitted and technical review can begin: <br />APPi.iCATinN FnRMe The Division requires receipt of the new applieaton form. <br />F.XHiRiT R _ fiite Decer~ntinn (g,~le (>r4.21~a„)le You must address Item (a) to the extent necessary to <br />demonstrate compliance with the applicable performance standard requirements of Rule 3. At a minimum, you <br />must include a description of the vegetation in the area of the proposed operation. The local office of the <br />Natural Resotsees Conservation Service (NRCS) may provide you with this information as well as <br />recommendations for Exhibit D -Reclamation Plan; <br />F.XHiRiT r - Snnree of f„ggal Riaht_tn_F.ntpr pt .ice 71_ provide a descripton of the basis for legal right <br />of entry to the site and to conduct mining and reclamation, for the Owners of Record described in <br />Subparagraph 1.6.2(I)(e)(i}. This may be a copy of access lease, deed, abstract of title, or a c7rrrent tax receipt. A <br />signed statement by the Landowner and acknowledged by a Notary Public stating that the Operator/Applicant has <br />legal right to enter and mine is also acceptable. <br />F.XHTRiT .i - Prnnf of Mailing jlTnfices of Permit Annlicalinn Rule 6 i_7Ole include proof of mailings of the <br />"Notice of Permit Application" sent to the Board of Supervisors of the local Soil Conservation Dist7ict, in the <br />application, by submitting the date-stamped receipt for Certified Mailing or adate-stamped copy of the notice <br />form with signature acknowledging personal service and receipt by the appropriate board. Also, refer to Rule <br />1.6.2(t)(a). <br />F.XH1RiT i, -Permanent Man_Made Ctructures !Bute 63.121e you must provide information sufficient to <br />demonstrate that the stability of any structures located within two hundred (200) feet of the operation or affected <br />]and will not be adversely affected.
