Everist, Inc.,
Ft. Lupton Sand and Gravel Mine, File No. M-99-120
This memo provides the results of my review of [he Applicant's adequacy response dated April 21,
2000. The issues addressed in the adequacy response were discussed in a meeting between the Division
and the Applicant held on April 20, 2000.
The Applicant must provide borehole data as described on page 4 of my memo dated March 22, 2000.
At the April 20, 2000 meeting it was discussed that the type of subsurface information required would
be provided as the result of an upcoming drilling program [o facilitate the design of the slurry wall.
This information can be provided to the Division confidentially under Rule 1.3 of the Construction
Material Rules.
The statement in the April 21, 2000 adequacy response that the Applicant will "adhere to industry
standazds for compaction as they relate to grain size distribution and permeability" does not provide any
utility for the Division's regulation of design and construction. However, as detailed in the March 22,
2000 memo, the Division's primary interest in the design of the interior dike is the placement of the two
types of fill proposed and the control of moisture content and compaction. The Applicant has
adequately addressed these concerns, and further information or specifications on the grain size
distribution or permeability is not required for approval.
c:\windows\personal\Ft.
