Deparhrrent of Natural Resources, <br />State of Colorado. <br />RECITALS <br />. - A. The Perrnittee, Kirkland Constmdion LLLP desires to conduct a mining operation known as <br />August Nicolas Pit, for the purpose of errtradmg borrow material for constmdion, sand and gravel. The <br />Perrrritiee will not mitre any secondary corrunodities. <br />B. On Jrme 19, 2002 the Mined I,arrd Reclamation Board (the "Board") approved the Perrrrittee's <br />application for this permit, fixed the amount ofthe fmancial warranty and directed that this permit be issued upon <br />the Sling with the Division of Materals and Geology (the "Division") of perfomrance warranty and furancial <br />war7arrty (or warranties) in the amount so fixed in form and substance approved by the Division. Said warranties <br />have been filed widr the Division. <br />C. If the Pemrittee desires to extract materials other than those listed in (A), a selrarate permit may <br />be required. <br />D. On Jrure 19, 2002 the Board made the following Endings: <br />1. The application for this permit complies with the requirements of the Colorado Mined <br />Land Reclamation Ad for the Extraction of Constnrction Materials, C.R.S. 34-32.5-101 ~ ~., as amended, and <br />with all applicable local, state and federal laws; <br />2. The operation will not adversely affect the stability of any significant, valuable, and <br />perman~rt man-made structure located within two hundred fect of the Affected Land, except where drere is an <br />agreement between the Operator and the persons having an interest in the s[ruchue that damage to the structure is <br />to be compensated for by the Perrnittee; and; <br />
