_ _ <. LEASE AGREEMENT This Lease Agreement made _~ 1997, by and between 1 Raymond J. Rugloski and Carolyn E. Ru I ski, 7301 Park County Road 59, P.O. Box ~4' G' ~~ ~ Hansel, Colorado, 80449, (herein referred to as "Lessors") and the Board of County ~~ Commissioners, Park County, Colorado, A Body Corporate and Politic, P.O. Box 220, Fairplay, CO 80440, (herein referred to as "Lessee"). WHEREAS Lessors note o~vn certain land, commonly known as the Chaparral Gravel Pit No. 2, ,located in Park County, Colorado; consisting of seven and three-quarters (7.7~) acres; fully and legally described in Exhibit A, attached hereto, and incorporated herein by reference, as if fully set forth herein, and WHEREAS Lessee no~v owns certain land, including the commonly known "Chaparral Gravel Pit", located in Park County, Colorado; consisting of forty (40) acres; fully and legally described in Exhibit B, attached hereto, and incorporated herein by reference, as iC fully set forth herein, and WHEREAS Lessee desires to lease the Chaparral Gravel Pit No. 2, described in Exhibit A, from Lessors, for the purpose o(mining the gravel contained therein, for the benefit and use of Park County, and WHEREAS Lessors desire to acquire Lessee's 40 acres described in Exhibit B, upon completion of Lessee's mining operation of Lessors' Chaparral Gravel Pit No. 2. NOW THEREFORE, in consideration of good and valuable consideration, described hereinbelow, the parties agree as follows: 1 . Lessors hereby grant to Lessee the sole and exclusive lease for the purpose of mining all available gravel from the Chaparral Gravel Pit No. 2, and removing said gravel from said premises for tfie sole and exclusive use of said County. 2. Inconsideration of said lease, Lessee will com~ey to Lessors, by general warranty deed, the 40 acres of real property described in Exhibit B, and all rights, title, interests and obligations in and to the property, and any and all surface and/or subsurface water rights ~~
