BLS
MEMORANDUM
TO: HARRIS SHERMAN, SECRETARY, MINED LAND RECLAMATION
FROM: DR. JERIS A. DANIELSON, DEPUTY STATE ENGINEER
SUBJECT: DORN READY-MIX GRAVEL PIT, MORGAN COUNTY, APPLICATION
FOR MINING AND RECIAMATION PERMIT
As requested by your office, we have reviewed the application for a gravel
pit near Fort Morgan. Exhibit G states that "no surface or ground water will
be appropriated or used in the gravel mining process". A considerable
amount of water will, however, be lost annually after mining through evapo-
ration from the 38 acre lake (Exhibit E) . In order to prevent injury to existing
senior water rights along the over-appropriated South Platte River, the appli-
cant must provide an approved plan for augmentation which replaces these
evaporation losses. If this is not done, the State Engineer may seek an
injunction from the court under the provisions of 37-92-502(7), CRS 1973,
in order to prevent obstructions to streamflow.
jAD/SSH:mvf
• - •
Y
~ \~iej 4N"~
~ 7876 ^
DIVISION OF WATER RESOURCES
Department of Natural Resources
1313 Sherman Street- Room 818
Denver.
