Box 1287 <br /> Montrose, CO 81402 <br /> Re: Olathe Pit -- File No. M-84-108 <br /> Dear Mr. Willey: <br /> I have reviewed your 110 permit application for the Olathe Pit for adequacy. <br /> Even though largely the same materials were approved before as a 1 1 , special <br /> permit to Terra Construction Company, I do have some adequacy conc rns which <br /> must be resolved before I can recommend that our Board approve a 1 0 <br /> application for the same site. Typically, given the 10-working da review <br /> period, an application for a Ill permit gets a somewhat cursory re iew. Thus, <br /> I have a few questions and comments about this application that ar organized <br /> on an exhibit-by-exhibit basis below. Any exhibit or part thereof not <br /> mentioned is considered adequate now. Please respond to this lett r <br /> earliest convenience, such that this matter will be ready for Boarj approval <br /> at the scheduled November 14-15, 1984, meeting. If we can resolve these few <br /> areas of concern, this application can be considered as a "no problem" item, <br /> and you will not need to be present at this meeting. <br /> First of all , enclosed please find bond number FS 132250 in the am unt of <br /> $5,000.00 from the Allied Fidelity Insurance Company. The amount f the bond <br /> is correct, but our Division no longer uses the "Reclamation Board .-Corporate <br /> Surety" form upon which the bond is executed. I have also enclosel our <br /> current form for this purpose, entitled "Financial Warranty--Corpo ate <br /> Surety" . Please resubmit the $5,000.00 financial warranty. <br /> I have reviewed the performance warranty and find it to be accepts le, with <br /> one minor correction to the legal description page (which I made) . The legal <br /> description originally read ". . .S 1/2 NE 1/4 and. . .". and I correct d it to <br /> correspond to Exhibit A, to read ". . .S 1/2 NE 1/4 NW 1/4 and. . ." . Unless I <br /> hear from you to the contrary, I will assume that this change meet with your <br /> approval .
