Preliminary review determined that the following items must be submitted before technical review of your application can begin: Application Form and Exhibits: The Division must receive a properly executed (signed and notarized) original plus one copy of the application form. The Division must also receive a second copy of all Exhibits (the City of Cripple Creek only submitted one copy of the Exhibits). EXHIBIT G - Source of Legal Right-to-Enter: You must provide a description of the basis of your legal right to enter the site and conduct mining and reclamation. This could be a copy of your lease, deed, abstract of title, or a current tax receipt. The Division will also accept a statement, acknowledged by a notary public, stating that the operator has legal right to enter and mine. Exhibit I - Proof of Filing with the County Clerk: You must provide an affidavit or receipt indicating the date on which the application was placed with the Teller County Clerk and Recorder. Proof of filing was not contained in the application package. EXHIBIT J - Proof of Mailing Notices of Permit Application: You must include proof of mailing of the "Notice of Permit Application" forms sent to the Board of County Commissioners and to the Board of Supervisors of the local Soil Conservation District. We suggest you submit the date-stamped receipt for certified mailing or a date-stamped copy of the notice form with signature acknowledging personal service and receipt by the appropriate board. Proof of mailings were not; contained in the application package.
