Preliminary review determined that the following items must be <br />submitted before technical review of your application can begin: <br />Application Form and Exhibits: The Division must receive a properly <br />executed (signed and notarized) original plus one copy of the application <br />form. The Division must also receive a second copy of all Exhibits (the <br />City of Cripple Creek only submitted one copy of the Exhibits). <br />EXHIBIT G - Source of Legal Right-to-Enter: You must provide a <br />description of the basis of your legal right to enter the site and <br />conduct mining and reclamation. This could be a copy of your lease, <br />deed, abstract of title, or a current tax receipt. The Division will <br />also accept a statement, acknowledged by a notary public, stating that <br />the operator has legal right to enter and mine. <br />Exhibit I - Proof of Filing with the County Clerk: You must provide an <br />affidavit or receipt indicating the date on which the application was <br />placed with the Teller County Clerk and Recorder. Proof of filing was <br />not contained in the application package. <br />EXHIBIT J - Proof of Mailing Notices of Permit Application: You must <br />include proof of mailing of the "Notice of Permit Application" forms sent <br />to the Board of County Commissioners and to the Board of Supervisors of <br />the local Soil Conservation District. We suggest you submit the <br />date-stamped receipt for certified mailing or a date-stamped copy of the <br />notice form with signature acknowledging personal service and receipt by <br />the appropriate board. Proof of mailings were not; contained in the <br />application package. <br />
