The Carol Ann Pit
needs are estimated at 25.86 ac-ft/yr. B&B has negotiated the use of 0.5 cfs (362 acre-feet) of water
rights for industrial use at the site, primarily for dust control. The current designated use of this
water is agricultural and will only be transferred to industrial use once DMG approval is granted.
This would save B&B the cost of contracting the rights if the permit is rejected. It is suggested that
a stipulation to the permit be made that requires proof of securing the water rights prior to allowing
any startup.

Carol Ann Permit CDMG Application 4 5
