The application was submitted on June 26, 1996 and <br />was initially called incomplete via DMG letter dated June 28, 1996. <br />The requested information was submitted on August 6, 1996 and the <br />application was called complete on that day. The decision date for <br />this application is September 5, 1996. The application is <br />generally adequate and well organized, however; there are a few <br />areas that will require the submittal of additional information or <br />clarification of the existing information. <br />Exhibit C-Mininq Plan <br />Under items (h) and (i) in this section, the narrative refers to <br />encountering groundwater, yet no well permit or augmentation plan <br />has been referenced. Prior to approval, clearance from the state <br />engineers office will be required. A letter from the Office of the <br />State Engineer detailing this requirement is enclosed. If there is <br />no clearance, the reclamation bond will calculated to include <br />backfilling the pit to prevent exposing groundwater after <br />reclamation. With the current information in the permit, the <br />Division is unable to determine what level the water would be <br />exposed. Therefore, the bond would have to be calculated to <br />include total backfill unless it can be determined what level of <br />backfill will be necessary to prevent groundwater exposure once <br />reclamation is completed. <br />Exhibit D-Backfill and Grading <br />There is some inconsistency with the proposed final slope <br />gradients. The reclamation map indicates that backfilled slopes <br />will be no greater than 3H:1V, however; the narrative in Exhibit D <br />states that maximum gradient of slopes will be 2H:1V. If reclaimed <br />slopes of steeper than 3H:1V are proposed, the operator must <br />include a justification that supports the steeper slopes for the <br />proposed post-mining land use in accordance with rule 6.3.4(1)(b). <br />The Division prefers 3H:1V or flatter backfilled slopes for <br />reclamation purposes due to the reduced erosion hazard and <br />
