I apologize for the delay in responding to you. <br />The Division has determined that a stormwater permit is not required for some small sand and gravel <br />mining operations in dry stream beds, if the following criteria aze met: <br />-All mining operations must be within the stream channel <br />-There cannot be an established haul road <br />-Equipment, supplies, etc. cannot be stored on site <br />-No permanent major structures can be on site <br />-Mining only occurs for relatively short periods of time during the year <br />Given your description of the pit, it appears that a stormwater permit is not needed. Keep in mind that <br />any change in this situation would require application for a stormwater permit, at least 30 days prior to <br />any discharge taking place. <br />I appreciate your attention to this matter.
