COLORADO BO]7f <br />(7031 337~6Y03 <br />SAMPLE LETTER <br />Dear Sirs: <br />Peabody Coal Company has submitted a Mining and Reclamation Permit Application for <br />the proposed Seneca II-W Mine located approximately eight miles south of Hayden (see <br />attached map). This application has been submitted to the Colorado Mined Lond <br />Reclamation Division to comply with the rules and regulations imp{ementing the <br />Colorado Surface Coal Mining and Reclamation Act. <br />• Under Section 2.05.5 of the Rules and Regulations of the Colorado Mined Land <br />Reclamation Board land owner comments with regard to the proposed post-mining land <br />use of The mine area after reclamation are to be submitted. Specifically, Section 2.05.5 <br />(I)(b) states: "The description of the reclamation plan and post mining land use plan" <br />shall be accompanied by a copy of the comments concerning the proposed use by the <br />legal or equitable owner of record of the surface of the proposed permit area and the <br />state and local government agencies which would have To initiate, implement, approve, <br />or authorize the proposed use of the land following reclamation." <br />Peabody Coal Company has worked to develop a reclamation plan that will reclaim the <br />lands affected by mining to a stable and productive {evel in order to restore the pre- <br />mining land uses of livestock grazing or cropland and wildlife habitat. Shrubs to be <br />established on lands affected by mining will be at much lower densities than existed prior <br />to mining. Other plant species to be used in reclamation were selected for their forage <br />quality and forage production value while still trying to meet the requirement of return- <br />ing amaximum number of native species. When reviewing the reclamation plan and <br />posimining land use plan, please keep in mind that while the primary goal is to restore <br />good livestock grazing and wildlife habitat, a number of other requirements have to be <br />met for the permit. These include erosion control, permanent vegetation cover, maxi- <br />mum use of native species, establishment of shrubs, adequate species diversity, and <br />restoration of cropland productivity. <br /> <br />
