Case No. 94CW036, Findings of Fact, Conclusions of Law and <br />Decree of the Court Approving Absolute and Conditional Ground <br />Water Rights, Plan of Augmentation and for Change of Water Rights, <br />Application of the City of Black Hawk, <br />Page 3 <br />Jan Gutierrez; Ron and Bobbi Kohen; Bill Locricchio; O. Viki Luna and Forrest B. Robinson; Deanna <br />L. Macy; Cathy J. and Lawayne G. Riedlinger; William D. and Penny Round; Marvin B. and Billie <br />Jean Smith; Merritt E. and Ramona J. Smith; Stephen R. Strauch; C. Wendell and Charla Waggoner; <br />and Evelyn Waldman. The two remaining pro se parties, Michael Vincent and Kimberly Vincent, <br />advised the Court by letter dated May 2, 2002 that they did not plan to submit any further <br />documentation or participate in the trial in this matter. <br />7. Timely and adequate notice of the Application, Amended Application, Second <br />Amended Application, Third Amendment to Application and Fourth Amendment to Application was <br />published, as required by law, and the Court has jurisdiction over the subject matter of this <br />proceeding and over all persons and water rights affected thereby, whether they have appeared or not. <br />The time for filing statements of opposition has expired. <br />8. The following parties have withdrawn their statements of opposition: Beverly <br />Building Company; David and Kathryn Fulenwider; Golden; Albert B. Dawkins; Lucie A. Crawley; <br />the Vidler Tunnel Water Company, Inc. and the Coors Brewing Company. Objectors The Farmers <br />Reservoir and Irrigation Company and Jefferson County, Colorado, did not participate at trial in this <br />matter. <br />9. Objectors, the Cities ofArvada, Central, Northglenn, Thornton and Westminster, the <br />Coors Brewing Company, the Farmers' High Line Canal and Reservoir Company, The Church Ditch <br />Company, FRICO, and the Board of County Commissioners for Gilpin County, entered into <br />stipulations as to the water quality portion of this matter, the terms of said stipulations are hereby <br />included in the Findings of Fact and Conclusions of Law set forth below. Said parties are precluded <br />by said stipulations from raising water quality injury issues after this decree is entered under the <br />jurisdiction of the Court retained in paragraph 33, below, except as provided by said stipulations. <br />10. The following parties have entered into stipulations with the Applicant on the basis <br />that those parties will not further oppose entry of a decree herein, and said stipulations are approved <br />by the Court and shall bind the parties to each said stipulation: <br />]O.a.
