Case No. 92-CW-059, Findings of Fact, Conclusions of Law and <br />Decree of the Court Approving Conditional Appropriative Rights of <br />Substitution and Exchange, Application of The City of Black Hawk, <br />Page 18 <br />downstream of the discharge point of the above-described wastewater treatment plants and from <br />which Arvada currently diverts water for municipal water supply uses. The Court shall retain <br />continuing jurisdiction hereunder to resolve all disputes that may arise among Arvada, Central City <br />and Black Hawk concerning this term and condition. This term and condition is enforceable only by <br />Arvada. <br />36. It is hereby decreed that the conditional appropriative rights of substitution and <br />exchange described herein are approved and meet the standards prescribed in C.R.S. § 37-92-301 et <br />seq., and will not injuriously affect any owner of or person entitled to use water under a vested water <br />right or a decreed conditional water right. <br />37. The application herein was filed in the Water Court in 1992 and the priorities <br />awarded herein shall be administered as having been filed in that year, and shall be junior to all water <br />rights for which applications were filed in previous years. As between all water rights for which <br />applications were filed in the same calendar year, priorities shall be determined by historical dates of <br />appropriation and are not affected by the date of entry of this decree. <br />It is therefore ORDERED, ADJUDGED AND DECREED by the Court that the <br />application for conditional appropriative rights of substitution and exchange is hereby granted. <br />IT IS FURTHER ORDERED that a copy ofthis decree shall be filed with the appropriate <br />Division Engineer and the State Engineer. <br />
