Case No. 92-C W-n59, Findings of Fact, Conclusions of Law and <br />Decree of the Court Approving Conditional Appropriative Rights of <br />Substitution and Exchange, Application of The Ci[y of Black Hawk, <br />Page 13 <br />Applicant. Notification to the Division Engineer or his designated representative of such non- <br />availability may be made by either Applicant or Coors. <br />32. In order to protect the vested rights of others from injury and to insure the <br />proper administration of this decree, Applicant shall account on a daily basis, and, at a minimum, <br />provide the following information to the Division Engineer or Water Commissioner by weekly <br />reporting and will install continuous measuring, recording and control devices requested by the <br />Division Engineer and reasonably necessary to provide the information required to administer the <br />decree: <br />32.a. The daily amount of water delivered to Applicant through the <br />exchange-to points and the amount and type of water used as a substitute supply at the exchange- <br />from points, under the priorities of the subject water rights, by the structure to which the water right <br />was exchanged. <br />32.6. The calling right on Clear Creek, North Cleaz Creek, or any of their <br />tributaries involved in the exchange, and the South Platte River, on each day the subject water rights <br />are exchanged. <br />32.c. The Division Engineer may require such additional data as he may <br />reasonably deem necessary for the proper administration of this decree and may prescribe the form in <br />which such data is presented. Copies of such reports shall be made available to Objectors at their <br />request upon payment of reasonable costs therefor. The accounting procedure and form is not <br />specifically decreed herein and may, due to operating experience and with permission of the Division <br />Engineer, require modifications without further court order. Any party aggrieved by any act of the <br />Division Engineer in effectuating the terms ofthis subparagraph or in failing to take action hereunder <br />may, upon notice to all other parties, refer the matter to the water court for determination, and <br />jurisdiction is reserved by the water court to determine such matters. <br />32.d. The accounting used for this decree shall be integrated with the other <br />water right components and decrees operated by Applicant. <br />33. Definitions. For purposes of the following paragraph no. 34, the following <br />terms shall have the following meanings: <br />33.a. "Subsequent Water CouR Cases": shall mean water quality aspects of <br />cases filed in the future by Black Hawk, Central City, and/or Gilpin County in which water court <br />approval is sought for augmentation plans and/or water exchanges in which effluent treated and <br />
