<br />PRIVACY AC7 <br />The Privacy Act of 1974 and the regulation in 43 CFR 2.48(d) provide that you be <br />famished the following information in connection with infortnetion required by this <br />application. <br />AUTHORITY': 30 U.S.C. 601 et, seq.; 43 CFR 3600 <br />PRINCIPAL PURPOSE: The inlormeticn ie to be used to identity the parties <br />entering into a contractual agreement for the disposal o[ mineral materials. <br />ROUTINE USES: (1) Contact applicants or pernittees about matters pertaining <br />to a contract or permit for the sale or free use of mineral meteri els [torn public <br />lends. (2) F'eport sales information to Congress pursuant to 30 U.S.C. 601 et. seq. <br />(3) Execute a contractual agreement for the disposal of mineral materiels from <br />public Innds. (4 )(5) Information from the record and/or the record will be trens- <br />ferted to appropriate Federal, Stetc, [seal or foreign agencies, when relevant to <br />civil, criminal or regulatory investigations or prosecutions. <br />EFFECT 0= NOT PROVIDING INFORMATION: Providing this fnformation is <br />mandatory to obtoin s contract or permit (or the dlsposel of minerol maleri ols from <br />public lands. - <br />Purchaser shall be liable !or ell loss suffered if Purchaser, his ton- <br />4ectors, or subcontractors, or employees of any o! them, are dire c[Iy <br />or indirectly responsible for the damage. If such material is dam- <br />aged or destroyed without (salt on the rr part, Purchaser shall be <br />liable for loss sustained to the extent that it is cepsed by his <br />failure to sever, extract, or remove the damaged materiel under the <br />circumstances and terms of this convect except that nothing herein <br />shall be construed to relieve etcher party from liability for breach of <br />contract or sny wrongful or negligent act. <br />Sec. 4. Specia! clauses and reserved items -The rights of Purchaser <br />shell be subject to the regulations in 4.3 CFR, Group 3600, (which <br />ere made s pert of this contract), subject to Section 9 of this con- <br />tract, and if thfs box ®is checked. the lollowfng stipulations <br />marked Exhibit B, which ere attached hereto and made s pert hereof. <br />The attached stipulations appear es consecutively <br />numbered pages commencing with page 1 ereafter. !f no stipulations <br />are attached this box ~ shell be merged. <br />Sec. 5. Bonds - (e) The Purchaser shell file with the Authorized <br />Officer and shall maintain et ell times 'the bonds required under the <br />regulation:: in 43 CFR 3610.1-5 to be famished os a condition to <br />the issuance of this controct in the amounts established by the <br />Authorized Officer. <br />(b) If ell terms of the contract ere not [e ith[ully and fully per- <br />formed by Purchaser, the performance bond required by 43 CFR <br />3610.1-5 in the sum of S 6~~~ filed et [hc <br />time of the signing of this contract shall be forfeited to the amount <br />o[ damages determined by the Authorized Otficer. If damages exceed <br />the amount of the bond, Purchaser hereby acknowledges liability for <br />such excess. Upon satisfeclory performance of lltis contract, the <br />bonds shall be canceled, or i[ cash or United States bonds were <br />famished in lieu of a surety bond, such cash or securities shell be <br />returned to Purchaser. <br />(c) Whenever any bond famished under this contract is found <br />unselisfac[ory by [he Authorized Officer, he may rr~quire a new bond <br />which is satisfeclory to him. <br />Sec. 6. Expiration of contract -This contract shall expire 5 <br />years from the date of approval unless an extension of time is <br />granted. <br />Sec. 7. Egua! opportunity clause -This permit i+: subject to the <br />provisions of Executive Order No. 11246 0[ Sept. 24, 1965, es e- <br />mended, which sets forth the nondiscrimination clauses. A copy of <br />this order may be obtained from the signing officer. <br />Sec. 8. Appeal - An appeal es provided by the rr gulations of the <br />Department of the Interior may be taken from any decision of any <br />subordinate official to the Director, Hureau of Lnnd Management, <br />and from the Director's decision to the Secretary of the Interior <br />pursuant to the Rules of practice (43 CFR, Pert 1870)• <br />Sec. 9.
