Cattany <br />Division DIrMOr <br />Natural Resource Trustee <br />On February 27, 2007, the Division of Reclamation, Mining and Safety sent to Westem Fuels <br />Association Inc an Incompleteness letter regarding DRMS Notice of Intent No. X-2007-142-10. We <br />received responses to that letter on April 2, 2007, and May 31, 2007. <br />Determination of Completeness [Regulation 2.02.2(2)] <br />The Notice of Intent is hereby deemed "Complete" as of today, for the following reasons: <br />1. In accordance with the requirements of Regulation 2.02.2(2)(e), we had requested <br />information pertaining to an application to the BLM for an Exploration License. The <br />response stated that an application for BLM Exploration License has been filed, and has <br />been given a designation by BLM of COC 69822. This addresses our Completeness <br />concern. The adequacy of the response is addressed below as new Item 13. <br />2. Also in accordance with the requirements of Regulation 2.02.2(2)(e), we had raised the <br />concern that some of the activities proposed by the Notice of Intent appeared to have <br />been located on fee land for which some form of right of entry had not been provided. <br />The response revised the location of these activities so as to limit them to pubic land <br />and to public roads on fee land. This addresses our Completeness concern. The <br />adequacy of this response is addressed below as new Item 14. <br />3. In accordance with Regulation 2.02.2(2)(h), we had requested "a statement, with <br />appropriate references from the relevant State or Federal agencies or published sources, <br />which determines that the exploration and reclamation describe will not jeopardize the <br />continued existence of an endangered or threatened species listed pursuant to Section 4 <br />of the Endangered Species act of 1973 (16 U.S.C. 1533) or the Nongame, Endangered <br />Office of Office of <br />Mined Land Reclamation Denver Grand Junction Durango Active and Inactive Mines <br />
