.. <br />(b) Tenant shall complete and pay for any land <br />reclamation required by any gover ental authority for that <br />portion of the Leased Premises dist bed by Tenant. <br />4.2 SURRENDER OF LEASED PREMISE At termination of the <br />term of the Lease, Tenant agrees to de i er the Leased Premises in <br />the same condition as Tenant received y it on the commencement <br />date of the Lease subject to the minin of Removed Materials as <br />referenced above. Within six (61 month after termination of the <br />Lease, Tenant shall remove all its t ade fixtures, stockpiled <br />materials, other installations, alterati ns or improvements on the <br />Leased Premises and shall complete all la d reclamation required by <br />any governmental authority, as set forth n Paragraph 4.1 (b) above, <br />as a result of Tenant's use and operati of the Leased Premises. <br />Tenant's obligation to observe and pe orm this covenant shall <br />survive expiration or other termination of the Lease. Any items <br />remaining on the Leased Premises after the six-month period as <br />referenced above shall be deemed abando ed for all purposes and <br />shall become the property of Landlord and the latter may dispose of <br />the same without liability of any type or nature. <br />ARTICLE V <br />INSURANCE <br />5.1 LIABILITY OF TENANT. Tenant shall protect, indemnify <br />and save Landlord harmless rom and agai st all and any liability <br />and expense of any kind arising from inju ies or damages to persons <br />or property on the premises arising out f or resulting in any way <br />from Tenant's use of the Leased Premise during the term of the <br />Lease. <br />5.2 NOTICE OF CLAIM OR SUIT. Eac of the parties agree to <br />notify the others of any c aim, act on, proceeding or suit <br />instituted or threatened against the p rties and/or the Leased <br />Premises. In the event Landlord is made a party to any action for <br />damages which Tenant has herewith ind ified Landlord against, <br />then Tenant shall pay all costs and hall pay, at Landlord's <br />option, the attorney's fees and costs in urred in connection with <br />said litigation by Landlord. <br />5.3 LIABILITY INSURANCE. Tenant <br />maintain, at Tenant's expense, public <br />respect to Tenant's use and occupancy of <br />personal injury limits of not less than <br />death to any one person, limits of not <br />injury or death iii any single incident, a~ <br />for property damage.
