Walther <br /> E.eeNLVe Director <br />RE: Division of Wildlife Comments on the New 11 2 Application Permit No. #M-99-098`Riverview Resources Michael8 Lnng <br /> Divumn D~reaor <br />Dear Mr. Sherman, <br />The Division of Minerals and Geology (DMG) received the Division of Wildlife (DOW) comments on the above <br />112 reclamation application, Permit No. #M-99-098, Riverview Resources, on February 29, 2000. DMG is <br />responding to thank you for your comments, and inform you that we had received previous copies of your November <br />5, 1999, comment letter addressing the Weld County special use permit for this project. This letter was included <br />along with various residents' objections to the proposed reclamation application, prior to the end of the public <br />comment period for this application on December 12, 1999. <br />DOW's comments were summarized for the January 7, 2000 Informal Conference to be as follows: <br />The Division of Wildlife's main concerns involving this development are the narrowing of the riparian <br />corridor associated with the Poudre River; obstruction of the movement oFfree-ranging wildlife; loss of <br />wetlands, subirrigated pasture, warm-water sloughs, wildlife movement corridors, and potential habitat; <br />water quality issues that may impact small fish habitats, and the permanent loss of wildlife value because of <br />increased human disturbance. They recommend a different seed mixture, a weed control plan, variation of <br />[he shorelines, protection of [he warm-water sloughs, careful design of the fencing so as not to trap wildlife, <br />a minimum 100-yard setback from the center of the river, and a complete survey for Preble's jumping <br />mouse and Ute Ladies' Tresses prior to the onset of mining. <br />DMG has reviewed [he application for #M-99-098, Riverview Resources, and addressed several of these issues. We <br />believe [hat the response of the Applicant [o our concerns a[ [his time has been adequate overall, and we intend to <br />recommend approval of this application pending resolution of a few outstanding issues on March 3. The Division is <br />anticipating holding aPre-Hearing Conference on March 14, 2000, in Greeley, Colorado. A Board Hearing for [his <br />application will be held on March 22, 2000. [f you wish, you may attend [he March Mined Land Reclamation Board <br />Hearing on March 22 as a member of the public and have your concerns heard at that time.
