_ ~~ <br />Mr. Lee Sutherland -2- March 22, 1994 <br />6. Paragraph 3 of Exhibit "C" says no overburden other than topsoil will be <br />removed from the site. As we discussed during the inspection, there is no <br />overt~urden at the proposed mine site so none will be removed. The topsoil <br />will be stockpiled for reclamation purposes. None will be removed from the <br />mine site. <br />7. Please specify what the nearest distance is from the proposed permit to the <br />edge of the San Miguel River. <br />8. The Doing ditch is within 200 feet of the proposed permit area. It is my <br />understanding that this ditch is owned by the landowner. Pursuant to <br />CRS 34-32-115(4)(d) you need to enter into an agreement with the ditch owner <br />so that damage to the ditch will be compensated for if the mining operations <br />damage the ditch. Otherwise, you will need to remain 200 feet away from the <br />structure. <br />9. Please clarify what your plans are for imgating the mine site. Per our <br />discussion, you will not irrigate the site. The landowner may irrigate the land <br />if he plants a crop after your permit has been terminated. But, you do not <br />intend to irrigate the permit area at any time during mining or reclamation. <br />10. In paragraph 2 of the reclamation plan you state "crops to be grown on the <br />area after mining." I think you meant crops will be grown after the permit has <br />been terminated because your selected post mining land use is rangeland. <br />11. Neither your mining plan or your reclamation plan says anything about the <br />highwalls at the pit. I need a narrative describing the height of the highwalls, <br />the proposed final grade (3:1 or less) and a contour map showing the final <br />configuration of the proposed permit area. <br />12. Gregg Squire, of this office, reviewed the seed mix you are proposing. He <br />suggests you reduce the pounds of live seed per acre to 4.0 Ibs of white clover <br />(for your cover crop), 4.0 Ibs of Western VJheatgrass, 2.0 lbs of Indian <br />Ricegrass, 0.4 lbs of Blue Grama, and 12.0 lbs of Buffalo grass. <br />Based on the proposed phased mining/reclamation plans, using the above noted seed mix, I <br />calculated the financial warranty bond requirement at $6,000.00. <br />Pursuant to Rule 1.5, your response to the above noted concerns will constitute a change to <br />your application. A copy of the changes must be given to the County Clerk and Recorder <br />and proof that the Clerk and Recorder received the copy must be sent to the Division. <br />
