I am <br />fiuru7iar with the area sturotrnding Lyons from multiple previotu visit4 to this area over the past two years. It is <br />my understanding that this site is currently rangeland and will continue as rangeland as the post-mitring land <br />ttse. Due to the small size of the area to be excavated and the lack of any critical habitat in this azea, I believe <br />that the request to extract construction materials has no significant potential to negatively impact wildlife <br />or wildlife habitat. <br />The mining site is within the overall ratrge of black bear, mountain lion, elk, mule deer, white-tailed deer, <br />and within the winter range of ells, winter concentration azea for mule deer, and wintering range and <br />concentration area ofwhite-tailed deer. Note [his site is also located within a dcsignated mountain lion <br />human conflict area. The mining site is within a designated foraging azea of peregrine falcon and the <br />winter range of bald eagle. <br />I am concerned for the safety of the deer in at this site if any fence is erected as some types of fencing can <br />be dangerous and even fatal to deer. Therefore, I recommend that if any fencing is to be used during this <br />operation then T prefer the use of/. strand t'encing with a bottom strand height of 17 inches and a <br />r*+aY+mum top strand height of 36 inches. <br />Numerous raptor species may potentially nest in the ponderosa pine trees and rocky cliff sides found on <br />and around the property. I suggest that the applicant check all trees that are to be removed and rocky <br />cliff areas to be mined for the presence of raptor nests prior to mining such areas. If nests are found T <br />recommend leaving intact all nest structures and support structures (trees, rocky outcrops, cliffs) and <br />mmimi~e disturbance to the area. I would like to request that the Division of Wildlife be contacted <br />immediately if the applicant does locate a raptor nest on the proposed mine .cite. In doing so, the Division <br />of Wildlife can then successfully work with the applicant so as to rn~r,;rn;.e disturbance to both the mining <br />operation and the wildlife and wildlife habitat during the raptor breeding season. <br />Should you feel there might be wildlife related issues which I am not aware of, please let me know and I wtTl <br />DEPARTMENT OF NATURAL RESOURCES, Greg E.
