Box 313 <br />Pueblo, CO 81002 <br />Dear Mr. Gower: <br />Colorado .4ir Quality Control Regulation No. 3, Section II.A. states that ". . <br />any person owning or operating any source, facility, process, or activity which <br />emits air contaminants through any permanently located chimney, stack, pipe, or <br />other conduit shall be required to file an Air Contaminant Emission Notice (ACEN) <br />with the .4ir Pollution Lontrol Division. ." <br />We have received Air Contaminant Emission Notices and the $40 filing fees for the <br />following sources operated by Broderick and Gibbons: <br />1) Asphalt Plant and Crusher Plant located at 1300 West Fillmore Street <br />in Colorado Springs. <br />2) Crushing Plant located at Lime Road in Pueblo. <br />3) Asphalt Plant located at 615 Sante Fe Drive in Pueblo. <br />4) Screening Plant located at Flying W Ranch in Colorado Springs. <br />The asphalt plant in Colorado Springs is presently permitted by the Air Pollution <br />Control Division. This permit (P-10,218) is still valid and does not require <br />updating as long as there is no significant change in operation of this plant. The <br />crushing plant operating at this site since 1955 does not require an emission permit. <br />If a substantial change should occur in the operation of this plant, than an emission <br />permit would be required. <br />The crushing plant located at Lime Road in Pueblo also does not require an emission <br />permit. Sources in operation prior to February 1, 1972 do not require an emission <br />permit unless a substantial change in operation has occurred since that time. <br />The asphalt plant located at 615 Sante Fe Drive in Pueblo also was in operation <br />prior to February 1, 1972 and does not require an emission permit. <br />It is my understanding after our telephone conversation on May 3, 1979, that the <br />portable screening plant located at the Flying W Ranch is actually part of the <br />crushing plant presently located at 1300 West Fillmore Street in Colorado Springs. <br />A separate ACEN for this screening plant is not required since it is a part of the <br />crushing plant mentioned above. You will, therefore, be receiving a refund of your <br />$40 filing fee for this source in the near future. However, each time this screening <br />~ L- <br />
