CROSS MOUNTflIN RflNCI~ <br />,`~ ~ COLORADO <br />February 20, 1997 <br />Richard Mills <br />Environmental Manager <br />Colorado Yampa Coal Company <br />29514 Routt County Road 27 <br />Oak Creek, Colorado 80467 <br />RE: Permanent Retention of Pond M <br />Colorado Yampa Coal Company Permit No. C-81-071 <br />Dear Mr. Mills: <br />Cross Mountain Ranch Limited Partnership (Cross Mountain) is the surface owner of <br />the tract of land upon which the above referenced pond is located. Specifically, the <br />pond is located in the NW/4NE/4 of Section 25, Township 5 North, Range 87W of the <br />6th P.M., Routt County, Colorado. Cross Mountain understands that Colorado Yampa <br />Coal Company (CYCC) is requesting Phase III bond release for its Mine 2 area upon <br />which the pond is located. Once the release is approved CYCC would be required to <br />remove the pond and ditch unless alternate provisions are made to retain the pond. <br />• - Cross MounEairi, as the surface owner,.requeststh~t Pond M be retained after Phase III <br />bond release. <br />Cross Mountain runs cattle on this and surrounding parcels and views retention of the <br />pond as beneficial to its operation. The pond has the ability to hold water for a <br />majority of the grazing season and this will help in distributing the cattle over our <br />property.
