Floodplain Study and Report of the Coloredo River from Rifle to Mamm <br />Creek dated February 20, 2001 by Schmueser Gordon Meyer, Inc. <br />Based upon the review of the above Irrtortnation, we have concluded that without <br />mitigation, the proposed activity poses a foreseeable and slgniflcant risk of injury m the <br />City's water works and pollution to the City's water supply. We have determined that the <br />proposed activity site will have a 10°~ chance (ie., 10-year food) in any given year to be <br />subjected to flows from the Colorado River. With the loss in erosion protection to the <br />streams overbank areas resulting from this activity and wfth the high probability of the <br />river overtaking these areas, the actNity poses a similar probability that the stream's <br />future natural dominant channel re-alignments will be accelerated. This accelerated <br />change in dominant channel loption will prematurely eliminate the City's ability to divert <br />water from its present bcation. Additionally, without mitigation, the high probability of <br />the topsoil pile(s) exposure to flood }lows from the Colorado River will impact the water <br />quality of the Colorado River at the City's current Intake structure. <br />Acquisition of alternate points of diversion for the City's Intake structure is a viable <br />alternative to offset foreseeable impacts from this activity. One alternative, which <br />Includes acquisition of the Baily Lake will offset both the water diversion and water <br />quality impacts. This alternative will allow the City to not directly divert Coloredo River <br />water during times of high turbidity and questionable water quality. Additional mitigation <br />measures including erosion control, berth re-location, construction of proper drainage <br />facilities, landscaping, reclamation and other recommended conditions of approval <br />outlined in the Agreement will serve to help offset the aforementioned impacts to the <br />City's water Intake structure and water quality. All of which may occur as a result of the <br />proposed activities. <br />Best Management Practices (BMP's) should be followed a1 ail times. These BMP's shall <br />include not only those proposed by the applicant but should also include compliance with <br />the conditions of this permit as well a compliance with conditions Imposed by other local, <br />state and federal permitting agendas. To ensure compliance, an annual report should <br />be prepared and submitted to the City by the applicant in January foilowed by an annual <br />inspection of the operations. All expenses of which should be born by the applicant. <br />This annual report should contain speclfic details of the plan of operetion for the pit as <br />well as the applicant's methods, procedures and plans to ensure compliance with this <br />and all other permits. <br />Staff, in consultation with the City Attorney and myself, recommends that the City issue <br />the watershed permit with the conditions proposed therein as well as enters Into the <br />proposed agreement with the applicant.
