<br />RIDER TO MINING PERMIT <br />Permit Date: January 11, 1999 <br />Perrrut No: M-97-054 <br /> <br />The following additional stipulations and conditions form an integal part of the foregoing permit: <br />Stipulation No. Description <br />The Applicant shall submit a financial warranty in the amount of $276,700.00 <br />2. The operator will monitor two of the 15 individual or multiple spring sources that were mapped <br />by Azurite, Inc„ and located on the north side of the Arkansas River on asemi-annual basis for <br />Flow rate Fluctuations and include the results of the monitoring with its Annual Report. If a <br />significant Flow rate decrease is observed which is above 2096 and not associated with a dry <br />season for the region, the operator shall promptly investigate the cause of the drop in flow rate <br />and promptly submit a report of it's findings to the Division. In addition, the Operator shall <br />measure the two monitoring wells located along the southern boundary of the permit area for <br />static water elevation on a semi-amual basis and include those measuremems in its Annual <br />Report. The operator shall promptly investigate any significant drop is static water elevation that <br />is not associated with seasonal conditions and prott~tly submit a report of the results of the <br />investigation to the Division. <br />To address the concerns about potential contamination from chemical methods used by the <br />operator for weed coturol, the Operator shall conduct water quality tests along with the <br />monitoring of the wells and springs provided for in this condition. The Division of Murals and <br />Geology will develop for the operator a list of the water quality parameters the operator will be <br />required to test. The parameters will be limited to those associated with the operator's use of <br />herbicides in implementing it's noxious weed (leafy spurge} management plan. <br />3. The berttonite clay liner of the fuel storage area will be compacted [o a perttteability of 1 x 10~i. <br />Prior to placement of the gavel liner, [he operator shall submit for the Division's approval the <br />results of four (4) evenly spaced permeabihty tests of the liner. The tests shall be performed by <br />a certified geotechnical engineer. <br />4. The operator shall report any significant fuel spills outside the containnten[ area to the Division <br />within 24 hours of the spill. The operator shall send to the Division, as soon as practicable, a <br />report on the mitigation of any potential pollution of the Bound water system due to the spill. <br />5. In the same manner as provided for the testing of quantity and quality testing of the two (2) <br />springs defined in Condition No. 1, the operator shall test the Mark N. And Jacque <br />Brown/Robert and Susan Steers spring located east of County Road 157 on a bi-annual basis, <br />provided the owners and users of the spring provide sufficient reasonable access to allow the <br />operator to conduct the sampling necessary for [he water quality [es[. <br />
