Effluent Limitations <br />g) Additional Conditions - effective at all times for all discharge points <br />There shall be no discharge of floating solids or visible foam in other than <br />trace amounts. The discharge shall not contain any sanitary wastewaters from <br />toilets or related facilities, or other pollutants not associated with active <br />mining operations. There shall be no land application of wastewater, other <br />than for dust control, without the previous authorization of a specific <br />discharge point. <br />h) Whole Effluent Toxicity - Chronic Lethality Limitation - Outfalls 004 and 008 <br />Beginning January 1, 1996 and lasting through May 31, 1997 there shall be no <br />statistically significant difference in lethality lat the 95t confidence <br />level) between the control and any effluent concentration less than or equal <br />to the IWC t effluent values (which are 71.0 f for outfall 004 and 67.5 & for <br />outfall 008). Such limitation shall apply as a daily maximum. <br />2. Burden of Proof Requirements <br />The permittee shall have the burden of proof when requesting relief from total <br />suspended solids (TSS), total iron and/or settleable solids limitations, as <br />• appropriate. Relief shall be granted only when necessary and shall not be granted <br />when the pexmittee has control over the discharge, enabling them to meet the <br />primary limitations. The permittee should endeavor to meet the primary <br />limitations whenever possible. All manual dewatering shall meet the primary <br />limitations. The Division shall determine the adequacy of proof. As part of this <br />determination, the Division shall evaluate whether the permittee could have <br />controlled the discharge in such a manner that primary limitations could have been <br />met. <br />For rainfall, to waive TSS and total iron limitations, it is necessary to prove <br />that discharge occurred within 48 hours after measurable precipitation has <br />stopped. In addition, to waive settleable solids limitations, it is necessary to <br />prove that discharge occurred within 48 hours after precipitation greater than the <br />10-year, 24-hour storm event. <br />For snowmelt, to waive TSS and total iron limitations, it is necessary .to prove <br />that discharge occurred within 48 hours after pond inflow has stopped. In <br />addition, to waive settleable solids limitations, it is necessary to prove that <br />discharge occurred within 48 hours after pond inflow volume greater than the <br />10-year, 24-hour event has stopped. <br />The Division shall determine the adequacy of proof. See Section ~I .B.3. <br />Post-Minina Areas - all discharge points <br />Commencing at the time active mining has ceased and surface areas have been <br />returned to the required contour, all applicable discharges shall be subject to <br />limitations other than those specified in Part I.A.1. These post-mining <br />limitations shall remain in effect until bond release.
