The iuent of this regulation is to afj'ord relief only when needed due to a volume of <br />water generated by a sperific storm evem, it is not imended to be automatically applied to all discharges caused by <br />precipitation, nor to be used to discharge volumes in excess ojthat generated by the storm event. On this basis, <br />• relief shall be granted only when necessary and shall not be granted when the permitree has control over the <br />discharge, enabling them to coca the primary limitations. The pemdttee should endeavor ro meet the primary <br />limitations whenever possible. Because manual dewmering can be accomplished as time and conditions permit, alI <br />manual dewatuing steal! be required to meet the primary limitations. The Division shall determine the adequacy <br />of proof. As parr of this duermination, the Division shall evaluate whether the pernuttee cau/d have controlled the <br />discharge in such a rwrmer that primary limitations could have been met. <br />
