The permit outlines the rest requirements and the required follow-up actions the <br />permittee must take to resolve a toxicity incident. The permittee should read, along with the documents <br />listed in Parrs I.A.4.a. and I.A.S.a. of the permit, the Colorado Water Oualirv Control Division <br />BiomonitorinA Guidance Documem. dared July 1, 1993. This document outlines the criteria used by the <br />Division in such areas as granting relief from WET resting, modifying test methods and changing rest <br />species. The permittee should 6e aware that some ojthe condirions outlined above may be subject to <br />change iJ the facility experiences a change in discharge, as outlined in Part I/.A.2. of the permit. Such <br />changes shall be reported ro the Division immediately. <br />6) Exemorion for Surface Runoff Only - Outfall 009.• The discharges from outfall 009 contain surface rtrnof( <br />solely and do not contairs toxic pollutants in toxic amounts. On this basis, WEI'testing is nor a requirement <br />for this outfall. However, the Division reserves the right to reopen the permit to include WET resting, I <br />should facility conditions change or if new information becomes available. <br />4. Srormwater Evaluation: Stormwater from active or inactive coal mining operations that has been contaminated by <br />contact with any overburden, raw material, intermediate products, finished products, byproducts or waste products <br />located on the site of such operations is required to be covered by a Colorado Discharge Permit System (CDPS) <br />permit in order to be discharged to Waters of the State. This coverage may be obtained under either a CDPS <br />Industrial Wastewater Discharge Permit or a CDPS Srarmwater Discharge Permit. Seneca Coal Company submitted <br />an application for a general permit for Metal Mining for the Seneca Mine Complex on February 23, 1996. This <br />jacilirv's certification under the general permit became effective on March 22, 1996. The Seneca Mine Canplex <br />certification number is COR-040!69. <br />Since the requirements for storntwarer permits have just recemly become effective, the Division's police is ro cover <br />as many facilities as possible Char are included in the regulations, with general permits. For facilities that also hai e <br />• individual CDPS permits for discharge of process water, any applicable stormwarer provisions would then be <br />included in individual COPS permits at the time of individual permit renewal or application. The individual permit <br />for discharge of process water for the Seneca Mine Complex, CDPS permit (No. CO-0000221), will contain <br />stormwater provisions. When this permit becomes effective, certification COR-040169 will be inactivated. Under <br />the terms of the combined individual permit (CO-000022]), Seneca Coal Company will be authorized to discharge <br />stormwater associated with industrial activity into waters of the State of Colorado. <br />The terms and conditions of this permit, as related to stormwarer discharges, include: <br />a. Se¢resation o(Stormwarer Discharges: AI! discharges covered by the stormwater portion of this permit shall be <br />composed emirely ojstormx~ater (except as discussed at Part I.D.2.b.9 ojthe permit). Stormwater x~hich mixes <br />with process water is subject to process water controls. Discharges from sources other than stormwarer must be <br />addressed by the process water controls in this CDPS permit. <br />b. Srormwater Management Plans (SWMPsI: The purpose of a SWMP is ro identrfv possible pollutant sources Char <br />mm~ contaminate stormwarer and to set out best management practices that, x•hen implemented, will reduce or <br />eliminate any possible water quality impacts. <br />A SWMP must 6e maintained for the Seneca Mine Complex in accordance with good engineering practices. The <br />plan identifies potential sources of pollution which mm reasonably be expected ro affect the qualirv of <br />srormwater discharges associated with industrial activity. In addition, the plan describes and ensures the <br />implementation of practices which are ro be used to reduce the pollutants irs stormwater discharges associated <br />x~ith industrial activity at the jacilin~, arui assures compliance with the terms and conditions of this permit. <br />Seneca Coal Company must implement the provisions of the SWMP as a condition of this permit. Contents and <br />requirements of the SWMP are discussed in the permit at Parr I.D.2.b . <br />• c. Compliance Dares: Seneca Coal Company was to have prepared the Seneca Mine Complex SWMP at the time of <br />application . The plan was ro have been implememed by upon issuance of the certification. The SWMP shall be <br />updated as appropriate. <br />Certification that a SWMP was prepared for the Seneca Mine Complex was received by the Division on February <br />23, 1996. <br />
