t.
COLORADO DEPARTMENT OF HEALTH - Watcr Quality Comro! Division
:~. Rationale -Page 13 Permit No. COR-040000
in Exhibit G of 110 reclamation perndu.
D. Denial of General Permit Caverare
Concern was upressed regarding the potential denial ojgeneral pernut mverage and subsequent prohibition
against discharge of stormwmer. The dmfr general permits provided that if on review of the appGcatian far
aert~cation under a genera! permit, the Division decider that an individual permhv required, in some cases it
appeared that no dischagge might be allowed until an individual permit was issued which requires at kart 180
days. The general permit/ have been cimifted. The Jnten! is to temporarily authorize such discharges with a
gerura/ pamU during the tune the lndi-adual permit is being prcparrd.
E. Report Due Dater
The permit hat bun clan; find to show the first possible due dare for annual reports for each permit type. the
permittu s cert~aotion will indicate the exact due date jot the first annual report.
F. Exemption for Pre-otxrational Mina
Concern war expressed regarding the exemption jar mining claims, prospects and exploration. The Division has
clarified the rationale to explicitly state that preopnational mining sits arc not required to obtain stormwatcr
permits. The definitions of arrive and inactive mining sits do noJ include sits where mining claims are being
maintained prior to any disturbances assoriated with the exrraesion, benef~riation, or processing of mined
materials, nor sits where minimal activities are undertaken for the sole purpose ojmaimaining a mining claim.
• Sites at which only exploration has bun awduaed arc incbdtd in this exemption from stormwater permit
requirements.
However, as clarjfiaation, claims on land when !here has bun past e~raction, beneficiation, or processing of
mining material, but there is cutremly no active mining, arc considered inactive sits and are subject to
stormwatn regulations.
Sarah Pkcher
September 10, 1992
•
