Natural Reeaurces <br />Re: Al Frei & Sons (Mann Marital Trust) <br />M & G Pit, n59-86-C <br />Sections 2 and 3, T2S, R67W <br />Dear Mr. Boehner: <br />As requested, we have reviewed the above referenced application for a <br />permit to mine sand and gravel on 109 acres near Henderson, Colorado, in Adams <br />County. Aground water lake will be created by the mining. From the applica- <br />tion, it is unclear whether the operator plans to put the reclaimed lake to <br />beneficial use. <br />The surface area of the pond that will be formed in the mining process is <br />58.7 acres. The amount of water lost to the South Platte River basin due to <br />evaporation from this amount of water surface is 152 acre-feet. The portion <br />of these losses which occurs during the irrigation season is equivalent to the <br />amount of water needed to meet the irrigation needs of approximately 68 acres <br />of corn. We used the Modified Blaney-Griddle Formula to calculate this <br />figure. Since the South Platte River is already over-appropriated, this will <br />result in a loss of water to downstream irrigators. <br />It appears that the ground water lake will be used by wildlife. Using an <br />impoundment of water for recreational purposes, inc]uding fishery and wild- <br />life, has been defined in Section 37-92-103, CRS (1973), as putting the water <br />to beneficial use. Since the source of water for the ]ake that will be <br />created by the gravel pit operation is ground water and the ground water will <br />be used beneficially, we require that a well permit be obtained from our <br />office. The well permit must be obtained prior to excavation of the gravel <br />pit. Otherwise, Al Frei & Sons will be in violation of Section 37-90-137, CRS <br />(1913). Since the proposed gravel pit would be Tocated in an over-appro- <br />priated basin, the well permit could not be obtained until a court approved <br />plan for augmentation has been developed. <br /> <br />
