SHELTO N, Director
Richard D. Lamm
Governor
February 24, 1984
Mr. Jack L. Hawkins
Western Slope Construction Company
949 Meeker Street
Delta, Colorado 81416
RE: Benton Dawson Gravel Site, Ftle No. 83-209
Dear Mr. Hawkins:
On February 23, 1984, the Mined Land Reclamation Board approved your
application fora limited impact mining and reclamation permit for the Benton
Dawson Gravel Site. Our staff recommendation for permit application approval
was based on the review by Rocky Beavers of your response to my last adequacy
letter. His review of your response also indicated that the probable costs to
the state of accomplishing your reclamation plan on the site would be at least
55,000.00. Therefore, as per my statement to you 1n my letter of January 27,
1964, our staff recommendation to the Board was to set the amount of the
financial warranty at (5,000.00. The Board approved this recommendation and
set the financial warranty at 25,000.00 as a part of their approval of the
application.
Upon receipt and staff approval of the warranty package for this operation
(consisting of a performance warranty and a financial warranty), a permit for
this operation will be issued to you. I have enclosed a copy of our
performance warranty form. It should be largely self-explanatory, but please
call me if you have any questions about it. You have several options for
submittal of the financial warranty for this operation. These Include a
corporate surety from an Insurance company, a letter of credit from a bank or
a deed of trust (first lien) on property owned by you and worth more than
55,000.00. Please let me know which of these options you wish to use, and
proper forms will be sent to you immediately.
Please call me if you have any questions.
Sincerely,
Mark-S.
