Dept. at Natural Resources <br />Denver, Colorado 80203 Telephone: 892-3567 <br />DEVELOP2fENT EuvD EXTRACTION MINING PERDfIT <br />TI7I5 PERMIT is issued this day of by the Mined Land <br />Reclamation Board, Department of Natural Resources, State of Colorado. <br />W I T N E S S E T H <br />WHEREAS, KASLER AND WOODS desires to conduct a surface mining operation, 1.-i~an <br />as Y,alf Moon Pit, for the purpose of extracting surface mined sand and „rave.l; and <br />WHEREAS, the Mined Land Reclamation Eoard has received a:i app'_iration, a <br />reclamation plan and map, the required fee, and a bond or surety for such operation <br />as required by law; and, <br />w11EREA5, the Mined Land Reclamation Board has made a finding, for the purposes <br />of issuing this permit, that: <br />1) the application complies with the requirements of the Colorado <br />Mined Land Reclamation elct and all applicable local, state and <br />Federal laws; and, <br />2) the operation caill not adversely affect the stability of any <br />significant, valuable, and permanent man-mado structures located <br />within nap hundred feet of the affected land, except cohere there <br />is an agreement between the operator and the persons having an <br />interest in the structure that damage to the structure is to be <br />compensated for by the operator; and, <br />3) the proposed mining operations and reclamation can be carried cu.t <br />in conformance caith the requirements of C.P.. S. 1973, 3a-32-116, <br />as amended (1976 Sess. Laws H.B. 1065); and <br />WHEREAS, for the purposes of issuing this pern~it, the operator has made a <br />satisfactory showing to the Board that he spill employ during and after his surfaces <br />mi.ni.ng operations procedures reasonably designed to minimize as much as pxact:c.;ble <br />the disruption from the surface mining operations and will provide for the rehabili- <br />tation of the affected land through the rehabilitation of p7.ant cover, sell st~b?1=.t y, <br />water resources, and other measures appropriate to the subsequent bcae.fici.al use or <br />such mined and reclaimed lands; and that in the event of the failure of his proposed <br />reclamatfen plan, tie gill take whatever measures whi.,h may be necessary 'n nrdc_ to <br />ass~:re the success of reclamation or' the lands affected by h.is surface mining op_ra- <br />tions; and, <br />k1iERF,AS, for the purposes of issuing this permit, a copy of the applicat.inn <br />approved by the tfined Land Reclamation Board of the State of Colorado is at*ached <br />to this permit and thereby becomes a Hart of the terms hereof. <br />NOW, THEREFORE, pursuant to the authority set forth in the Colorado Piined Lr..:i <br />R~es_lamation Act, Article 32 of Title 34, C.R.S. 1973, as amended, (1976 Sess.
