I`Aining. <br /> <br />The existing surface runoff control structures have all been checked for compliance <br />with the applicable regulations of the Colorado Mined Land Reclamation Board for Coal <br />Miring, and do comply with the regulations, or will comply upon the completion of remedial <br />work previously recommended and described in this Exhibit. This remedial work consists of <br />adding orifice plates on the Streeter Gulch and loadout area sedimentation ponds' principal <br />spillway pipes to provide longer detention times for sedimentation, some work on the Streeter <br />Gulch sedimentation pond spi Ilway, and raising a low area in the Streeter Gulch sedimenta- <br />tion pond embankment. <br />Please contact us if you have questions, or need any revision or additional detail <br />included in this Exhibit. <br />Very truly yours, <br />TIPTON AND KALMBACH, INC. <br />E.
