characterized by a narrow channel with steep cliffs on the northern side of the creek. The location of the creek is <br />shown on Map 23B., Structures and Renewable Resources. <br />The projected impacts to the creek are presented in Exhibit 7E, Prediction of Subsidence, Eastern Expansion to the <br />Foidel Creek Mine, in the Probable Hydrologic Consequences section of this application. As noted in Exhibit 7E, <br />subsidence varies from 40 to 79 inches over these panels. It is not anticipated that this will cause significant <br />changes to the creek's profile, and resultant erosion should not be a concern. With the type of subsidence that <br />occurs, i.e. trough-shaped, ponding would be the most likely process to occur, and this would merely increase the <br />amount of riparian habitat along the creek. TCC's experience with panels 9 Right, 8 Right, 7 Right and 6 Right <br />shows that ponding will occur and the extent of ponding is controlled by how deeply incised the stream is in it's <br />impacted reach. <br />Prior to full extraction mining under the creek, a channel survey will be completed to enhance the information used <br />in the preparation of the probable hydrologic consequence section of the permit. Full extraction under Middle <br />Creek has occurred from the mining of panels 6 Right, 5 Right, and 4 Right. Panels 3 Right and 2 Right will be <br />mined in late 1999 through 2000. <br />U.S.G.S. Station 700 <br />The station, which is a surface water monitoring site, is located in the SE/4, Section 13, TSN, R86W. No impacts <br />are projected for this site because it will not be undermined or subsided. The location of the station is shown on <br />Map 23B. <br />EMD (Panels 2 Right through 6 Right) (PR97-04) <br />The mining to be undertaken in the area covered by this permit revision will see a continuation of the undermining <br />• and subsiding of the structures discussed above in Permit Revision No. 93-03. <br />Land Use <br />Pastureland is the predominant land uses in the Eastern Mining District. Historically, some of the areas, i.e. part of <br />Section 21, have been identified as cropland. Recently, however, the decision was made to return it to pastureland <br />as it is the more appropriate use for these lands. The land use patterns are presented in Map 3, Premining Land <br />Use. <br />The reason for returning these areas to pastureland is that the previous landowners had broken out pastureland and <br />rangeland and planted grain crops. This was done typically in response to governmental programs. Presently a <br />federal program exists which compensates landowners returning these marginal cropland areas to grasslands. TCC <br />is not involved with this program but has acquired lands, which were enrolled in the CRP program. TCC has <br />elected to keep these areas in grass or plant them back to pastureland. The current land uses in the surrounding area <br />also demonstrate that previously marginal croplands have been returned to grasslands. Therefore, it is TCC's <br />opinion that pastureland was and is the appropriate use for these lands in and around its affected areas. <br />Existine Residences/Structures <br />Two residences will be undermined and subsided during this five-year permit term, which will be from 1998 to <br />2003. One of the residences is occupied year round, while the other residence is used periodically during the year <br />on a limited basis. TCC has a subsidence agreement with the owner of the residences and has agreed to repair <br />subsidence damage to the residences and temporarily relocate the resident while mining occurs. It is anticipated <br />this will occur during the 2"d quarter of 1999. <br /> <br />Permit Renewal No. 3 2.05-181 11/1/99 <br />
