45. The signed engineer's statement is acceptable except that US Hwy 6 appears to be located within 200 <br />feet and is not included on the permanent manmade structure list. Please correct this discrepancy. <br />46. Response acceptable. <br />Please submit proof that all owners of surface and mineral rights to the affected area, and all landowners <br />within 200 feet of the affected area have been properly notified per rule 1.6.2(e). DMG has no record <br />that the notice of publication, per rule 1.6.2(e), was mailed or personally served to Butler, Ute Water <br />District, Xcell Energy, or Qwest Communications. Please submit proof that these entities were notified, <br />or indicate that they are not surface or mineral owners of record as specified by Rule 1.6.2(e). If new <br />notice is being sent to these entities, please request an extension of the decision date that allows the <br />entities notified, a twenty (20) day period to comment. Alternately, the applicant can submit a signed, <br />notarized document from these entities, waiving their right to a twenty day comment period, in lieu of <br />extending the decision date. <br />Additional Adequacy Comment mailed to applicant dated December 16, 2005. <br />The revised seed mixes proposed on the Reclamation Plan Map are acceptable. However, the <br />Reclamation Plan Text does not reflect this revised two zone revegetation scheme and has the <br />original seed mix specified.
