ANN MACKE17~~MERSON and .fEAN <br />MACKENZIE COLON, whose nddress is 1340 College Avenue, Canon City, <br />Colorado 81212 (heroin the Landowner), and R.E. MONKS CONSTRUCTION <br />COMPANY. a Colorado Corporation, whose addraea is P. 0. Box 25579, <br />Colorado Springs, Colorado 80936 therein the Cowpony). <br />Whereas the Landowner and the Company presently hnve an agreement <br />between thewselvea for the wining of certain properties in portions of <br />Sections 11, 13 and 14, Township 19S, Range 69W, of the 6th Principal <br />Meridian in Frewont County, Colorsdo, known as Airport Pit N3. <br />Whereas the Company has decided the wort efficient manner to <br />rewove rock and tend products from the wining lease area is towards the <br />north through property of the Landowner, through Airport Pit KS <br />operated by the Company, and onto State Highway 30. <br />Whereas the Landowner understands the advantages of this routs. <br />Therefore the Landowner grants to the Company an access road <br />across lnnds owned by the Landowner for the purpose of removing rock <br />and sand products trove the wining lease arse, wovement of wining <br />equipment, and access by personnel of the Company. This access road <br />easement 'is graphically described on the Access asewent Location Map, <br />described as Exhibit A and wade a part of this Agreement. The access <br />eacawent is sixty feet C60') in width with a travel surface of between <br />twenty-eight feet <28') and thirty-two feet <32'). <br />The Landowner grants this access road easement to the Company for <br />a tern concurrent with the wining lease. Extension of the wining lease <br />autowatically extends the terw of this Access Road Agreement for the <br />aawe length of tine. <br />The Company will control erosion along the length of the access <br />road and will not disrupt surface drainage. The Cowpony will properly <br />install adequately sized culverts to transport surface runoff from the <br />uphill side of the access road to the downhill side. <br />The Company will Snstell cattle guards et fence locations along <br />the access road which travels through property owned by the Landowner. <br />In addition the Cowpony will instnll a security gate at the northern <br />wont property line of the Landowner in order to prevent unauthorized <br />personne Stow entering th• Landowner's property. <br />The Cowpony will operate ell trucks, wining equipment vehicles, <br />and other vehicles in a safe wanner in order to avoid. damage to <br />property and cattle. <br />After wining has been completed and the wining lease has expired, <br />the Cowpony will lenve this access road in a usable eondiilon in order <br />to provide access to the reclaimed pasture land. <br />This Agreement shall be binding upon the heirs, executors, <br />personal representatives, cuccessors, and assigns of both the Landowner <br />and the Company. <br />Agreed to by' <br />~~- ~ <<1- <br />R.
