Section 816.97 (c) Continued. <br />• <br />No new electric power lines and other transmission facilities used <br />in conjunction with surface mining activities on the permit area <br />are planned. In the event that new facilities become necessary, <br />they will be constructed by Kerr Coal to the specifications set <br />forth in Environmental Criteria for Electric Transmission Syatema <br />and Protection of Bald and Golden Eagles from Powerlinea (USDI, <br />USDA (1970)) so the potential problem of raptor electrocution will <br />be eliminated. Existing electric power lines and other transmis- <br />sion facilities will be brought into compliance with such specifi- <br />cations as provided in Section 780.12. New distribution lines <br />which are constructed by Kerr Coal will be designed and constructed <br />in accordance with REA Bulletin 61-10, Powerline Contracts by <br />Eagles and Other Large Birds. Existing distribution lines not <br />constructed according to these specifications will be brought into <br />compliance with the standards set forth in such Bulletin ae pro- <br />• vided in Section 780.12. <br />(d) Each person who conducts surface mining activities shall, to the <br />extent possible using the best technology currently available-- <br />(1) Locate and operate haul and access roads so as to avoid or minimize <br />impacts to important fish and wildlife species or other species pro- <br />tected by State or Federal law; <br />(2) Fence roadways where specified by the regulatory authority to guide <br />locally imgortant wildlife to roadway underpasses. No new barrier shall <br />be created in known and important wildlife migration routes; <br />(3) Fence, cover, or use other appropriate methods to exclude wildlife <br />from ponds which contain hazardous concentrations of toxic-forming <br />materials; <br />816-113 <br />
